Professional Misconduct and Malpractice in the Field of Law

West Virginia’s Rules of Professional Conduct lay out what professionalism entails in the practice of law in our state. Licensed attorneys are expected to adhere to these standards. The rules are extensively explained giving both attorneys and their clients a foundation for behavior that should and should not occur in the attorney-client relationship. The American Bar Association also provides guidelines for what is considered to be professional misconduct.

In West Virginia, clients who believe their lawyer has engaged in unethical behavior can file complaints with the Lawyer Disciplinary Board claiming that the attorney violated the Rules of Professional Conduct. This Board has the authority to investigate, conduct hearings, and make recommendations as to what disciplinary actions, if any, should be taken in any individual case.
