    Morgantown Professional Misconduct Lawyer

Defending Against Misconduct Allegations in the Legal Field Throughout West Virginia

When an attorney engages in legal malpractice, their behavior can negatively impact a client’s case, resulting in personal, reputational, and financial harm. Malpractice can consist of some type of negligence or wrongdoing, such as an action or omission that violates professional standards or breaks civil or criminal law. However, just because a case result was less than optimum or not what the client desired does not automatically mean that the attorney engaged in unprofessional or unlawful conduct.

At Mountaineer Criminal Law Group, we are here to help defend against accusations of professional misconduct as an attorney. Our firm is dedicated to helping you achieve optimum results in the face of allegations that could destroy your career, lead to disciplinary action, or lead to civil or criminal penalties upon a conviction in court. With more than a decade of intensive experience in criminal law, including extensive trial practice, our Morgantown professional misconduct attorney has the knowledge, insight, and skills to aggressively fight for your best interests.

Professional Misconduct and Malpractice in the Field of Law

West Virginia’s Rules of Professional Conduct lay out what professionalism entails in the practice of law in our state. Licensed attorneys are expected to adhere to these standards. The rules are extensively explained giving both attorneys and their clients a foundation for behavior that should and should not occur in the attorney-client relationship. The American Bar Association also provides guidelines for what is considered to be professional misconduct.

These include but are not limited to such actions as:

    • Committing criminal acts
    • Engaging in “fraud, deceit, or misrepresentation”
    • Engaging in discrimination or harassment that violates civil rights

In West Virginia, clients who believe their lawyer has engaged in unethical behavior can file complaints with the Lawyer Disciplinary Board claiming that the attorney violated the Rules of Professional Conduct. This Board has the authority to investigate, conduct hearings, and make recommendations as to what disciplinary actions, if any, should be taken in any individual case.

    Legal Malpractice

Legal malpractice is based on a breach of the duty of care that an attorney is expected to meet as a professional, leading to client harm and damages. Accusations of this nature can result in legal claims and lawsuits made against the implicated attorney.

Examples of this type of negligence or wrongdoing can include but are not limited to:

    • Misuse of client funds
    • Overbilling
    • Failure to file legal claims before the statute of limitations ends
    • Concealing evidence
    • Making false or misleading statements
    • Conflicts of interest
    • Breach of contract
    • Faulty or insufficient case preparation
    • Insufficient understanding of the law
