DUI Test and Lock Program in West Virginia

The West Virginia DUI Test and Lock program is officially called ATLP or the Motor Vehicle Alcohol Test and Lock Program. This program deals with installing the ignition interlock device in your car and monitoring you through it so that you don’t drink and drive. This lock will require you to blow when you are getting in the car and if you have alcohol in your blood, the car will not start.

This lock will come with a tube and will need you to blow in it. Only a judge can order you to install this in your car. This can be an alternative to your license suspension in some of the cases.

When you are installing this device in your car, there will be many questions you will have. For this, come to us at Mountaineer Criminal Law Group. Our Morgantown DUI lawyer will answer all your queries.

Test and Lock Eligibility

Depending on the impaired driving charges that police have charged you with, your eligibility for the test and lock program will be decided. Our West Virginia DUI lawyer will explain that to you.

  • Our lawyer will tell you whether this program is in your best interest or not. If it is, then you will have to submit an application form along with a mandatory fee of $100. The paperwork can be confusing as there are many things that you will have to fill up in the form. If you are having difficulty, our Morgantown DUI lawyer will help you with the paperwork.
  • In case you are charged with non aggravated DUI first offense where your BAC is lower than .15%, then you can opt for an ignition interlock device instead of losing your license for six months.
  • If you are charged with aggravated DUI where your BAC level is more than .15%, then you can keep your license by going for an ignition interlock device for ten and one-half months.

Special Circumstances for Revocation of License and Lock Installation

The special circumstances will have harsher punishment. This type of situation will include serious injury or death with your DUI charges. In this case, your license will be suspended for a longer period and the ignition interlock device will be in place for a long period of time. Depending on the charges you get, this punishment will be determined.

If your transportation to work or school requires you to drive, then getting the ignition interlock device will be a better option than getting the license suspended. And that is what our West Virginia DUI lawyer will help you to understand. Sean Logue has many years of experience and that is why he understands what will be the best circumstances for you.

Client Reviews

I had hired Mr. Logue a few years ago for my gf at the time for charges she had gotten before I had met her, for prostitution. Big mistake to date her and pay for her lawyer as we didn’t work out but Mr. Logue far exceeded expectations. He got nearly all charges in 2 separate cases dropped for her...

I was arrested on a felony 3 charge looking at at least up to 2 years in prison. County District Attorney didn't want to negotiate. After a lot of hard work, Sean was able to plead the case all the way down to just 90 days jail with a work release. Better deal than I realistically could have hoped...

Mr. Logue took our son’s cases on very short notice (the first lawyer we hired wasn’t getting anywhere with either of the prosecutors and had actually turned one of the cases over to the court-appointed attorney). We hired Mr. Logue to go to trial if needed, but he worked with both prosecutors and...
